Terms of Service

By creating an account or using RektAds ("Service", "we", "us"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, do not access or use the Service.

RektAds is a SaaS platform that connects to Meta Ads accounts, analyses creative performance using artificial intelligence, detects creative fatigue, and generates ad copy and creative briefs. The Service is intended for marketing professionals and businesses running paid advertising campaigns on Meta platforms (Facebook and Instagram).

• You must provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must be at least 18 years old to use the Service.
• One person or legal entity may not maintain more than one free trial account.
• You must notify us immediately at support@rektads.com if you suspect any unauthorised access to your account.

To use the full features of RektAds, you must connect a valid Meta Ads account. By doing so, you authorise RektAds to access your ad data (creatives, spend, performance metrics) in read-only mode, solely for the purpose of providing the Service. We do not post, modify, pause, or delete anything in your Meta Ads account. You may disconnect your Meta account at any time from the Settings page.

We offer a 14-day free trial with full access to the features of your chosen plan. No credit card is required to start a trial. At the end of the trial period, your account will be automatically downgraded to a limited free tier unless you subscribe to a paid plan.

• Paid plans are billed monthly or annually in advance via Stripe.
• Your subscription renews automatically at the end of each billing period unless cancelled before the renewal date.
• Monthly AI usage quotas (analyses and content generations) reset at the start of each billing period and do not roll over to the next period.
• We reserve the right to change pricing with at least 30 days' written notice. Continued use of the Service after the price change takes effect constitutes acceptance of the new price.
• Failure to pay may result in account suspension or downgrade to a restricted plan.

You may cancel your subscription at any time from your billing dashboard. Cancellation takes effect at the end of the current billing period - you retain full access until that date.

EU consumers: In accordance with Directive 2011/83/EU on consumer rights, you have the right to withdraw from your subscription contract within 14 days of purchase without giving any reason, provided you have not yet used the Service during that period. If you have used the Service during the withdrawal period (e.g. run an analysis), you expressly consent to immediate performance of the contract and acknowledge that your right of withdrawal is forfeited upon use. Outside the 14-day withdrawal window, subscription fees are non-refundable. We do not issue refunds or credits for partial months, unused time, or unused quota.

You agree not to:

• Use the Service to violate any applicable law or regulation.
• Reverse-engineer, decompile, scrape, or attempt to extract our proprietary algorithms or platform code.
• Share or resell account access with unauthorised third parties.
• Use the Service to generate content that is deceptive, fraudulent, harmful, or illegal.
• Attempt to circumvent usage limits, quotas, or access controls.
• Abuse the free trial system by creating multiple accounts.
• Introduce malware, viruses, or other malicious code into the Service.

We reserve the right to suspend or terminate accounts that violate these rules, without refund.

You retain ownership of your underlying ad data and any content you bring to the platform. AI-generated outputs (copy, briefs, creative scores) are provided for your use - you may use, modify, and publish them without restriction.

RektAds retains all rights to its platform, software, algorithms, UI designs, and documentation. Nothing in these Terms grants you any licence to our intellectual property beyond what is necessary to use the Service.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI analysis or generated copy will improve your advertising results. Marketing outcomes depend on many factors outside our control.

To the maximum extent permitted by applicable law, RektAds shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of or inability to use the Service, including loss of revenue, data, goodwill, or business opportunities.

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the total amount you paid us in the three (3) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud.

We strive for high availability but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance with or without prior notice. We are not liable for any losses resulting from downtime or service interruptions.

You may cancel and delete your account at any time. We may suspend or terminate your account immediately for material violations of these Terms, including fraudulent activity, abuse, or non-payment. Upon termination, your access to the Service ceases and your data may be deleted after 30 days in accordance with our Privacy Policy.

We may update these Terms at any time. We will notify you by email or in-app notification at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of Spain, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.

If you are an EU consumer, you also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
